Privacy Policy

The Baobab Collective Ltd ("Company", "we", "us", or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information when you visit our website or use the ChatXport desktop application ("Software").

The Short Version

ChatXport is designed with privacy as a core principle. The Software runs on your device. Your chat messages, photos, and files are never uploaded to our servers or transmitted anywhere. The only network request the Software makes is a periodic license verification call to our payment provider (Gumroad) to confirm your purchase is still valid. This call sends only your license key. This Privacy Policy covers information collected through our website, the purchase process, support communications, and the license verification described above.

1. Information We Collect

1.1 Information You Provide

When you purchase ChatXport or contact us, we may collect:

  • Contact information: name and email address
  • Payment information: payments are handled entirely by Gumroad. We do not receive or store your full payment details (card numbers, billing address, etc.).
  • Communications: any messages you send to our support team

1.2 Information Collected Automatically

When you visit our website, we may automatically collect:

  • Device information: browser type, operating system, device type
  • Usage data: pages visited, time spent on pages, referring website
  • IP address: used for security and analytics purposes

1.3 Information NOT Collected by the ChatXport Application

The ChatXport desktop application does NOT collect, transmit, or store on our servers:

  • Your chat messages or their contents
  • Photos, videos, or documents from your chats
  • Contact names or phone numbers
  • Any data from files you open in the application
  • Usage analytics, telemetry, or crash reports from the application

All processing of your chat exports happens locally on your device. No chat data is ever sent to any server.

1.4 License Verification

When you activate a paid license, the Software sends your license key to api.gumroad.com to verify the purchase. After activation, the Software periodically re-checks the key (approximately once every 30 days, when the app is opened) to confirm the purchase has not been refunded or charged back. This request sends only the license key. No chat data, usage data, or personal information is included.

If the Software cannot reach Gumroad (for example, if you are offline), it continues to work using the locally cached verification result until the next successful check.

1.5 Data Stored Locally on Your Device

The ChatXport application stores the following on your computer, inside your user profile's application data folder (%APPDATA%\com.thebaobabcollective.chatxport\ on Windows):

  • A cached copy of any chat ZIP files you save through the app (for reopening without re-importing)
  • Bookmarks, notes, and workspace structures you create inside the app
  • A signed license verification cache (containing your tier and the date of the last successful check)

This data never leaves your device. You can view it, move it, or delete it at any time by opening the folder above. Uninstalling ChatXport and removing this folder deletes all locally stored data permanently.

1.6 Microsoft Store

ChatXport is distributed through the Microsoft Store. When you download or install ChatXport from the Microsoft Store, Microsoft may collect information in accordance with their own privacy policy. We do not control or have access to data collected by Microsoft during the download or installation process. For details, see Microsoft's Privacy Statement.

2. Legal Basis for Processing

We process your information based on the following legal grounds:

  • Contractual necessity: to deliver the software you purchased, process payments, provide license keys, and fulfill our obligations to you as a customer.
  • Legitimate interests: to improve our services, ensure security, prevent fraud (including the periodic license verification described above), and respond to support inquiries.
  • Consent: for marketing communications such as product updates and newsletters. You can withdraw consent at any time by unsubscribing.
  • Legal obligations: to comply with applicable laws, regulations, and legal processes.

3. How We Use Your Information

We use the information we collect to:

  • Process your purchase and deliver the software license
  • Provide customer support and respond to inquiries
  • Send important updates about the software (security patches, major updates)
  • Improve our website and marketing efforts
  • Comply with legal obligations

4. Email Communications

If you join our email list or purchase ChatXport, we may send you:

  • Transactional emails: purchase confirmations, license keys, download links
  • Product updates: important software updates and security notices
  • Marketing emails: product news and tips (you can unsubscribe anytime)

You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email or contacting us directly.

5. Information Sharing

We do not sell, trade, or rent your personal information to third parties. We may share information with:

  • Gumroad: our payment processor, to handle purchases and license verification
  • Email service providers: to send transactional and marketing emails
  • Legal authorities: when required by law or to protect our rights

6. Data Security

We implement appropriate technical and organizational measures to protect your personal information, including:

  • HTTPS encryption on our website
  • Secure payment processing through Gumroad
  • Limited access to personal data on a need-to-know basis
  • Regular security reviews of our systems

No method of transmission over the Internet is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

7. Data Retention

We retain your personal information for as long as necessary to:

  • Maintain your software license and provide support
  • Comply with legal and accounting requirements
  • Resolve disputes and enforce our agreements

Data stored locally by the ChatXport application (bookmarks, notes, cached ZIPs) is retained on your device and controlled entirely by you. You can delete it at any time by removing the app data folder or uninstalling the software.

You may request deletion of personal data we hold (such as your email address or support correspondence) at any time by contacting us. Deletion requests may not apply to information that Gumroad is required to retain for legal or financial purposes.

8. Cookies and Tracking

Our website may use cookies and similar technologies to:

  • Remember your preferences (such as cookie consent)
  • Analyze website traffic and usage patterns
  • Improve our website and marketing

You can control cookies through your browser settings. Disabling cookies may affect some website functionality. The ChatXport desktop application does not use cookies or web tracking.

9. Your Rights

Depending on your location, you may have the right to:

  • Access: request a copy of the personal data we hold about you
  • Correction: request correction of inaccurate personal data
  • Deletion: request deletion of your personal data
  • Portability: request your data in a portable format
  • Objection: object to certain processing of your data

10. Children's Privacy

ChatXport is not intended for children under 16 years of age. We do not knowingly collect personal information from children under 16. If you believe we have collected information from a child under 16, please contact us immediately.

11. International Data Transfers

The Baobab Collective Ltd is based in Kenya. If you access our website or purchase our software from outside Kenya, your information may be transferred to and processed in Kenya or other countries where our service providers operate. By using our services, you consent to such transfers.

12. Third-Party Links

Our website may contain links to third-party websites. We are not responsible for the privacy practices of these external sites. We encourage you to read the privacy policies of any third-party sites you visit.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website with a new "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the updated policy.
